Welcome to Rent Card, a rental property portal operated by Addabb, a firm registered in the State of Haryana, India. By accessing or using our website at rentcard.in (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Definitions

  • "Platform" refers to the Rent Card website and all its features.
  • "User" refers to any individual who accesses the Platform, including renters, landlords, and administrators.
  • "Renter" refers to a user searching for rental properties.
  • "Landlord" refers to a user who lists properties for rent.
  • "Listing" refers to a property advertisement posted by a landlord.
  • "Inquiry" refers to a message sent by a Renter to a Landlord through the Platform.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use this Service. By registering, you confirm that you meet these requirements.

3. User Accounts

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for safeguarding your password and for all activities conducted under your account.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or unlawful activity.

4. Use of the Platform

You agree to use the Platform only for lawful purposes. You shall not:

  • Post false, misleading, or fraudulent property listings.
  • Impersonate another person or entity.
  • Harass, threaten, or harm other users.
  • Attempt to gain unauthorized access to any part of the Platform, its systems, or other users' data.
  • Use automated scripts, bots, or scrapers to extract data without our written permission.
  • Submit content that is defamatory, obscene, or infringes on intellectual property rights.

5. Property Listings

  • Landlords are solely responsible for the accuracy, completeness, and legality of their listings, including rent amounts, property descriptions, photographs, and availability.
  • Rent Card does not verify the ownership, condition, or legal status of listed properties. Listings are provided for informational purposes only.
  • We reserve the right to remove any listing that violates these Terms, is reported as inaccurate, or is otherwise objectionable, without prior notice.
  • Landlords grant Rent Card a non-exclusive, royalty-free license to display listing content on the Platform for the purpose of operating the Service.

6. Inquiries and Communication

  • The Platform facilitates communication between renters and landlords. Rent Card is not a party to any rental agreement, lease, or transaction between users.
  • When a renter submits an inquiry, their contact details (name, email, phone) are shared with the relevant landlord so the landlord can respond.
  • Landlord contact details are not displayed publicly. They are revealed to renters only when the landlord chooses to reply.
  • Users are responsible for verifying the identity and credentials of the other party before entering into any agreement.

7. No Brokerage or Agency Relationship

Rent Card is an online classifieds platform that connects renters with landlords. We are not a real estate broker, agent, or property management company. We do not:

  • Participate in any rental negotiations or transactions.
  • Collect rent, security deposits, or any payments on behalf of landlords.
  • Guarantee the availability, condition, or legality of any property.
  • Verify the claims made in listings or inquiries.

8. Fees and Payments

Currently, creating an account, browsing listings, and submitting inquiries on Rent Card is free of charge. If we introduce paid features, premium listings, or subscription plans in the future, the applicable fees will be clearly disclosed before any payment is requested, and separate terms will apply.

9. Refund Policy (No Refunds)

All payments made to Addabb / Rent Card are non-refundable. By making any payment on the Platform, you acknowledge and agree that:

  • There are no refunds, credits, or chargebacks for any fees paid, regardless of whether you continue to use the Service or not.
  • Listing fees, premium placement fees, subscription charges, and any other payments, once processed, cannot be reversed.
  • If you cancel your account or a listing is removed (by you or by us), no refund of any prior payment will be issued.
  • We reserve the right to offer refunds or credits at our sole discretion in exceptional circumstances, but this does not create any obligation.
  • Any chargeback or payment dispute initiated against us without prior written communication will be treated as a violation of these Terms.

10. Disclaimers

The Platform is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, Addabb and Rent Card:

  • Make no warranties or representations about the accuracy, reliability, or availability of the Service.
  • Do not guarantee that the Platform will be uninterrupted, error-free, or secure.
  • Are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service.
  • Are not responsible for the conduct, listings, or communications of any user on the Platform.
  • Do not endorse any property, landlord, or renter.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Addabb's total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to us in the three (3) months preceding the claim, or ₹1,000 (Indian Rupees One Thousand), whichever is lower. This limitation applies even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Addabb, its partners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, your infringement of third-party rights, or your dealings with other users.

13. Intellectual Property

The Platform's design, logo, content, software, and all intellectual property are owned by Addabb. You may not copy, modify, distribute, or create derivative works from the Platform without our written consent. User-generated listing content remains the property of the respective landlord.

14. Account Termination

You may delete your account at any time by contacting us. We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to the Platform or other users.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Panchkula, Haryana, India.

16. Dispute Resolution

Before initiating legal proceedings, both parties agree to attempt in good faith to resolve any dispute through written negotiation within 30 days. If unresolved, the dispute shall be referred to mediation in Panchkula, Haryana. If mediation fails, either party may initiate legal proceedings in the courts of Panchkula.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of the Platform after changes are posted constitutes acceptance of the new Terms. We encourage you to review this page periodically.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent authority, the remaining provisions shall continue in full force and effect.
